| Resolve conflicts faster and at a lower cost. The U.S. legal system is the best in the world. However, it has become very costly to hire an attorney. It is not unusual for one to spend $2,000-5,000 just to file a lawsuit. Counter-claims, depositions, discovery, and meetings with lawyers run the cost of a typical, simple commercial litigation from $5,000-$20,000. Our court system is so backed up that it is not unusual for it to take 15-24 months just to get a trial date for a civil litigation matter. Then, there are the usual delays and postponements. Many matters are settled out of court. Even if you are 100% right, it is often a better business decision to give a little to (a) get the matter over with, and (b) reduce your own legal costs to defend (or prosecute) the matter to "prove your point". Mediation is method of resolving disputes between parties that is fast, fair, and inexpensive. In mediation, parties sit down at a conference room table. A Mediator is a trained professional that helps the parties communicate with each other towards a common goal of resolving the dispute. A Mediator helps each party talk about their position and clarify their point of view. A Mediator helps each party listen to the other so that they fully understand the other side's point of view. Once each side truly listens to the other, the road is paved for a successful resolution. A mediator cannot force the parties to agree. Many mediations are successful; but some are not. The mediator is not there to decide who is right or who is wrong. The mediator is there to facilitate the parties in reaching a mutually agreed upon solution. If the parties do not agree, or if one party elects to leave, the other is not obligated. At a mediation, each party may be represented by a lawyer, if they choose. Legal representation is not required; although it is an option. Usually, each party pays their own lawyer and the cost of the mediator is split between the parties. The Maryland Association of Realtors® (MAR) provides for mediation services to help buyers and sellers resolve a dispute involving a real estate transaction. MAR has contracted with Lisa Cameron at O.M. Services, located at 960 W. Pulaski Hwy in Elkton MD 21921 (1-800-291-9542) to handle mediations in accordance with paragraph 17 of the standard purchase agreement throughout the State of Maryland. In addition, there are many fine mediation services in the Baltimore area.
